Paul Butler Associates successfully appealed and were awarded full costs against the refusal of the local planning authority to grant planning permission for the change of use of a house in Tintwistle, Derbyshire to a 6-bed residential care home for young people (C3 to C2).
In allowing the appeal, the Planning Inspector agreed with our view that the proposed use would not result in an increase in vehicular or pedestrian movements and considered that the local planning authority’s claims to the contrary were entirely unsubstantiated and therefore wholly unreasonable.
